While that has already been accomplshed, the problem isn't what's in the indictment, it's what's not in the indictment. Lying by omission and failing to disclose material evidence is falsifying evidence and tampering.
There are at least three violations of Federal Rules of Criminal Procedure.
Normally small infractions would simply mean a defective indictment and the prosecutor eould be given an opportunity to perfect if. However, when its to the degree and severity as with this instrument, it's grounds for dismissal because it lacks legal basis.
Even without that this is based on untested legal theory.
Let's pretend everything was perfect and none of the above existed. Each of the laws require willful intent, which short of a signed confession, is almost impossible to prove. So even if it wasn't fantasy law, it would still unlikely survive an appeal.
